Welcome to Hiawasi. These Terms of Service (“Terms”) govern your access to and use of Hiawasi.art, including the website, online store, products, artwork, services, content, and purchases made through the Website.
Hiawasi.art is operated by Braylin Frazier, doing business as Hiawasi (“Hiawasi,” “we,” “us,” or “our”).
By accessing Hiawasi.art, placing an order, or purchasing a product through the Website, you acknowledge that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, please do not use the Website or place an order.
1. Hiawasi and Our E-Commerce Platform
Hiawasi.art is built and operated using Squarespace, which provides website hosting and e-commerce functionality.
Squarespace provides the technology that allows Hiawasi to display products, accept orders, process checkout, and operate the Website. However, Hiawasi is the seller of the products offered through Hiawasi.art and is responsible for the customer-facing aspects of those sales, subject to applicable law.
Squarespace is not the seller of Hiawasi artwork or merchandise and is not responsible for the products sold by Hiawasi.
Your use of Squarespace services is also subject to the applicable Squarespace terms and policies.
2. Printify Fulfillment
Some Hiawasi products may be produced, manufactured, packaged, or shipped through Printify and independent third-party Print Providers.
Printify may fulfill orders on Hiawasi’s behalf, but Hiawasi remains responsible for the customer-facing sale and applicable obligations relating to orders placed through Hiawasi.art.
The particular Print Provider used for an order may vary based on product availability, production capacity, geographic location, shipping requirements, and other fulfillment considerations.
As a result, packaging, manufacturing location, shipping carrier, and production times may vary between products.
3. Products
Hiawasi sells original artwork, prints, limited-edition works, apparel, home goods, and other products featuring original Hiawasi artwork.
We make reasonable efforts to ensure that product descriptions, photographs, colors, dimensions, materials, and other product information are accurate.
However, the appearance of a product may vary slightly from photographs displayed on the Website.
Differences may result from:
Screen and monitor settings;
Photography and lighting;
Printing processes;
Paper, canvas, fabric, or other materials;
Manufacturing processes; and
Normal production tolerances.
Minor variations that are consistent with the manufacturing or printing process do not necessarily constitute defects.
4. Original Artwork
Original artwork is individually created by Hiawasi and may contain characteristics associated with handmade artwork, including brushwork, texture, paint variation, surface irregularities, and other artistic qualities.
When you purchase an original artwork, you acquire ownership of the physical artwork.
You do not acquire ownership of the copyright, trademark rights, reproduction rights, or other intellectual property rights associated with the artwork unless Hiawasi expressly transfers those rights to you in a separate written agreement.
Hiawasi retains all applicable intellectual property rights in its artwork.
5. Limited-Edition Artwork
Hiawasi may offer limited-edition prints or other limited-release artwork.
When an artwork is identified as limited edition, Hiawasi determines the edition size and may individually number pieces within an edition.
Once a limited edition has been exhausted, Hiawasi may not reproduce or restock that edition.
Purchasing a limited-edition work does not grant the purchaser copyright or reproduction rights.
6. Copyright and Artwork Usage
All artwork created by Hiawasi, including paintings, illustrations, designs, digital artwork, photographs, graphics, logos, product imagery, written content, and other creative materials displayed on Hiawasi.art are protected by applicable intellectual property laws.
Except where expressly stated otherwise, Hiawasi retains all rights in its artwork and creative materials.
Purchasing an Hiawasi product does not give you permission to:
Reproduce the artwork;
Scan or digitally recreate the artwork;
Create prints or copies;
Trace or recreate the artwork for commercial purposes;
Create merchandise featuring the artwork;
Use the artwork as a logo, trademark, or brand identity;
Sell or license reproductions;
Use the artwork for commercial advertising or promotional purposes;
Upload the artwork to another print-on-demand service;
Remove artist attribution or copyright information; or
Claim the artwork as your own.
Personal display of a legally purchased physical product is permitted.
Commercial reproduction, licensing, publication, merchandise use, or other commercial exploitation requires prior written permission from Hiawasi.
7. Pricing
Prices displayed on Hiawasi.art may change at any time.
Hiawasi may change prices based on factors including material costs, production costs, fulfillment costs, shipping costs, artist pricing, limited-edition availability, and other business considerations.
A product’s previous price does not establish a permanent or guaranteed price.
Hiawasi reserves the right to correct typographical, pricing, inventory, or product-description errors.
If an order is affected by a significant pricing or listing error, Hiawasi may cancel the order and issue a refund of amounts paid for the affected order.
8. Orders and Acceptance
When you place an order through Hiawasi.art, you are submitting a request to purchase the selected products.
An order confirmation indicates that your order has been received. It does not necessarily mean that the order has entered production or that the product is available without limitation.
Hiawasi reserves the right to cancel or refuse an order when reasonably necessary, including because of:
Product availability;
Pricing or listing errors;
Suspected fraudulent activity;
Unauthorized payment activity;
Technical errors;
Fulfillment limitations; or
Other circumstances preventing legitimate fulfillment.
If Hiawasi cancels an order after payment has been received, the applicable amount paid for the cancelled order will be refunded.
9. Payment
Payment is collected through payment methods made available through the Squarespace checkout and applicable payment processors.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method provided.
Hiawasi does not ask customers to send full payment-card numbers, security codes, passwords, or banking credentials through email, social media, or other informal communication channels.
10. Production and Processing
Certain products sold through Hiawasi.art are made to order.
Printify-fulfilled products may require production before they are shipped.
Production times are estimates and may vary due to:
Product availability;
Print Provider capacity;
Seasonal demand;
Holidays;
Supply-chain issues;
Weather;
Technical issues; or
Other circumstances outside Hiawasi’s reasonable control.
Production time and shipping time are separate.
An order may require several days for production before it is transferred to a shipping carrier.
11. Shipping
Orders are shipped to the address provided during checkout.
Customers are responsible for providing a complete and accurate shipping address.
Hiawasi is not responsible for delays or additional costs caused by an incorrect or incomplete address supplied by the customer.
Shipping estimates are not guaranteed delivery dates.
Delivery may be affected by carrier delays, weather, holidays, customs processing, transportation disruptions, or other circumstances outside Hiawasi’s reasonable control.
12. Printify Production and Fulfillment
For products fulfilled through Printify, Hiawasi may rely on Printify’s production and fulfillment network.
Printify may select or assign an appropriate Print Provider based on available production and fulfillment considerations.
Hiawasi does not guarantee that every Printify-fulfilled product will be manufactured at a particular facility or shipped using a particular carrier.
Some shipments may contain packaging, labels, or other information associated with a Printify production or fulfillment partner.
13. Returns, Refunds, and Exchanges
Returns, refunds, cancellations, and exchanges are governed by Hiawasi’s separate Return & Refund Policy.
Because many Printify products are produced only after an order is placed, non-defective returns or exchanges may not be available for every product.
Hiawasi’s policies are designed to remain reasonably consistent with the applicable Printify fulfillment and refund procedures.
Nothing in these Terms is intended to waive or restrict a consumer right that cannot legally be waived or restricted.
14. Damaged, Defective, or Incorrect Products
If your order arrives damaged, defective, or materially incorrect, please contact Hiawasi promptly using the contact information provided on Hiawasi.art.
For Printify-fulfilled products, Hiawasi may need to submit the issue to Printify or the applicable Print Provider for investigation.
Customers may be required to provide photographs of the product, packaging, shipping label, or damage.
Printify’s current procedures generally require order issues to be reported within specified timeframes and may require photographic evidence before a reprint or refund can be approved. Hiawasi will determine the appropriate customer resolution based on the circumstances, applicable law, and the policies and remedies available through the relevant fulfillment provider.
15. Incorrect Size, Color, or Customer-Selected Details
Customers are responsible for reviewing product selections before completing an order, including applicable size, color, quantity, design, and shipping information.
Printify generally does not treat an incorrectly selected size or color as a manufacturing defect and may not provide a refund or replacement for those circumstances. Where an order has already entered production, cancellation or modification may not be possible.
16. Order Cancellations
Cancellation requests should be submitted as soon as possible after an order is placed.
For Printify-fulfilled products, an order may be cancelled only before it reaches the stage where production or fulfillment can no longer be stopped.

If a cancellation is accepted, any applicable refund will be processed in accordance with Hiawasi’s Return & Refund Policy and applicable payment-processing procedures.
17. Lost or Returned Shipments
If a package is confirmed lost in transit, Hiawasi may work with the applicable shipping carrier and/or Printify to determine whether a replacement or refund is available.
If a package is returned because the customer provided an incorrect or incomplete address, additional shipping or replacement costs may apply.

18. International Orders and Customs
International customers are responsible for providing accurate delivery information and complying with applicable customs requirements.
International shipments may be subject to customs duties, import taxes, brokerage charges, or other fees imposed by the destination country.
Unless expressly stated otherwise at checkout, these charges are the customer’s responsibility.
Hiawasi cannot guarantee a specific international delivery date.
19. Custom and Personalized Products
If Hiawasi offers custom or personalized products, customers are responsible for providing accurate information, names, dates, dimensions, references, and other requested details.
Custom orders may have separate terms regarding deposits, revisions, approvals, cancellations, production timelines, and refunds.
Those terms will be provided to the customer where applicable.
20. Taxes
Applicable sales taxes and other transaction-related taxes may be calculated and collected through the Website and applicable payment or tax systems.
Hiawasi is responsible for applicable tax obligations associated with its e-commerce activities to the extent required by law.

21. Customer Reviews and Submitted Content
Customers may have opportunities to submit reviews, photographs, testimonials, comments, or other content.
By submitting content, you represent that you have the necessary rights to submit it and that the content does not violate another person’s rights.
If you voluntarily submit content for publication, you grant Hiawasi permission to display and use that content for purposes related to operating, promoting, and marketing Hiawasi, subject to applicable law.
Hiawasi does not acquire ownership of your underlying intellectual property merely because you submit content.
22. Acceptable Website Use
You agree to use Hiawasi.art only for lawful purposes.
You may not:
Attempt unauthorized access to the Website or related systems;
Interfere with Website security or functionality;
Use malicious software or code;
Use bots or automated systems to abuse the Website;
Scrape or systematically reproduce Website content without permission;
Commit fraud;
Impersonate Hiawasi or another person;
Infringe intellectual property rights;
Use Hiawasi artwork without authorization; or
Use the Website in violation of applicable law.
Your use of Squarespace-powered portions of the Website must also comply with applicable Squarespace policies, including its Terms of Service and Acceptable Use Policy.
23. Third-Party Services
Hiawasi uses third-party services to operate portions of its business.
These may include Squarespace, Printify, payment processors, shipping carriers, analytics providers, email services, and other service providers.
These providers may have their own terms, policies, privacy practices, and operational requirements.
Hiawasi is not responsible for independent services or practices outside Hiawasi’s reasonable control.
24. Privacy
Your use of Hiawasi.art is also governed by the Hiawasi Privacy Policy.
Information submitted through the Website may be processed by Hiawasi and applicable service providers for purposes including processing purchases, fulfilling orders, providing customer support, communicating with customers, maintaining the Website, and operating the business.

To the maximum extent permitted by applicable law, Hiawasi.art and its content are provided on an “as is” and “as available” basis.
Hiawasi does not guarantee that the Website will always be uninterrupted, error-free, secure, or available.
Nothing in these Terms excludes or limits a warranty or consumer protection that cannot legally be excluded or limited.
27. Limitation of Liability
To the maximum extent permitted by applicable law, Hiawasi will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or relating to use of the Website or purchase of products.

28. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Hiawasi and its owner from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Website, violation of these Terms, or infringement of another person’s rights.
29. Force Majeure
Hiawasi is not responsible for delays or failures caused by circumstances outside its reasonable control, including severe weather, natural disasters, fire, war, governmental action, labor disruptions, transportation interruptions, supply shortages, manufacturing disruptions, internet failures, technology failures, or other extraordinary circumstances.
30. Changes to These Terms
Hiawasi may update these Terms from time to time.
When changes are made, the “Last Updated” date will be revised.
Your continued use of Hiawasi.art after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
31. Governing Law
These Terms will be governed by the laws applicable to Hiawasi and its business operations, without regard to conflict-of-law principles, except where applicable law requires otherwise.
32. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
33. Entire Agreement
These Terms, together with Hiawasi’s Privacy Policy, Return & Refund Policy, Shipping Policy, and any additional terms expressly incorporated into them, constitute the agreement governing your use of Hiawasi.art and your purchases from Hiawasi.
